My brother was involved in an accident while he was in a school van, the van got hit by another car.My brother had neck injury and was in therapy for several weeks.This was 12 years ago and the law suit went into effect then and the attorney has been telling my mother that the insurance company will not release the check until my brother turn 18. My brother turned 18 a week ago and the attorney’s paralegal has been going around the bushes with my mom about my brother’s money,what can we do ?

Something smells fishy. When you state that the attorney’s paralegal has been beating around the bush AND that the insurance company would not release the check until your brother turned 18, it sounds a little strange. Assuming that the Insurance Company has released the check, the attorney is supposed to make every effort to “promptly” turn the check over to the client. Your parents hired the attorney and if you/they think they’re being given run around, they have a right to complain to the State Bar Association. The State Bar will definitely look into it and resolve the matter. Sometimes even the “threat” of complaining to the State Bar will get an attorney to take care of their business. If your parents are being screwed by the attorney, the State Bar will likely suspend the attorney’s license to practice law, in addition to making them turning over whatever monies they are due.
