On April 5, ACS hosted a national press briefing on BCI Coca- Cola Bottling Co. of Los Angeles v. EEOC, a case the Supreme Court will hear on April 18. In this case, the Court will consider the circumstances in which an employer may be held liable under federal anti-discrimination laws when a supervisor, who harbors racial or other discriminatory bias toward a subordinate, influences the decision to fire that employee, though the prescription drugs without a prescription decision is made by a more senior supervisor who harbors no such bias himself. The civil rights and business communities agree that the outcome of this case will have a significant impact on the workplace but disagree on what standard the Court should adopt.
